The Control Of Asbestos Regulations 2012


The Control of Asbestos Regulations 2012 will come into force on the 6th April 2012. Unfortunately, due to the tight timescales required to bring the revised regulations into force it has not been possible for the HSE to issue guidance in advance. However, the changes to the regulations were explained in the Consultative Document and the information provided then has not substantially changed.

 

The main changes:

 

1.       Employers carrying out some types of non-licensed work will now be required to notify that work (NNLW).

2.       Ensure employees who work with asbestos (NNWL) have medical examinations at least once every 3 years and a record is kept of the work done by each employee. There will be a three year transition period to 30 April 2015 before the new requirement for employees carrying out some types of non-licensed work to have a medical examination comes into force.

3.       The core requirements of the existing regulations to carry out a risk assessment, plan work, put in place suitable control measures and train employees are all unchanged.

4.       The work for which a licence is required is also unchanged as are the requirements relating to licensed employees.
